The puppy identified above is sold for the sum of $_____________to be paid in full prior to being picked up or shipped. $_____________was received on / / as a non refundable deposit. There is no refunds on deposits. The reason for this penalty is in the direct relation to the support cost for the care and maintenance of the dog until a new owner becomes available. This is a good faith promise of your intent to purchase. A great deal of personal time goes into each puppy received. In the event of outright cancellation, all monies received by Donoma’s Kennel will be retained and used in direct relation to support cost and maintenance. NO refunds in whole or part.

GUARANTEE: We guarantee this puppy is purebred and registerable with AKC. We guarantee that all vaccinations and wormings have been given as stated on the vaccination schedule. We encourage the buyer to have this puppy examined by a licensed veterinarian of their choice within 48 hours of taking possession of this puppy. If this puppy is found to have a life threatening hereditary or congenital defect or any major health problem at this exam, a full refund or replacement puppy of equal value will be given. Seller must be notified within 24 hours after the exam. This puppy must be returned to the breeder within 24 hours at no cost to the breeder with a signed document from the licensed veterinarian stating the defect or problem. We the breeder are not responsible for any veterinarian bills acquired by you the buyer. This guarantee does not cover uneven bites, undescended testicles, injuries, fleas, mites, ringworm, kennel cough, hernias, coccidia, giardia, or any other intestinal worms/parasites, as they are common in dogs and puppies. The breeder will not be responsible for Parvo, Distemper, or Corona Virus after 48 hours of the sale, as these are highly contagious diseases and they can be contacted immediately after leaving the breeder. We will not be responsible for illness or health problems which are diagnosed after this time period except where stated in this contract.

Your puppy is guaranteed for 2 years from date of birth against life threatening congenital defects and crippling hip/elbow displasia which renders the dog unsuitable as a pet. For OFA preliminary evaluation x-rays must be done after puppy/dog reaches 12 months of age. If OFA rating is unacceptable (moderate or severe HD/ED kennel will require a second set of x-rays be done when puppy/dog reaches 24 months of age (must be notified of results by age of 26 months). Only a certified OFA report will be accepted for hip/elbow displasia. If within 2 year time a life threatening congenital defect (not to include parvo and distemper virus, heart-worms, or any nutrition related disease) or crippling hip/elbow displasia is found by a licensed veterinarian or OFA, the breeder will replace the puppy with another puppy of same quality and price after the puppy is returned to breeder. The replacement will be subject to availability. The puppy will be replaced and no money will be refunded. The buyer must provide at the buyer’s expense a written statement from a licensed veterinarian. We the breeder is not responsible for any veterinary bills acquired by you the buyer. We will not be responsible for any illnesses or any health problems which are diagnosed after this time period.

In the unlikely event of this puppy’s death in the two years due to congenital defect, a statement from a veterinary confirming such an event and cause is required before any action will be taken by the breeder. If cause is unknown, an autopsy is required. The breeder will not be responsible for veterinary or medical bills incurred.

Puppy is sold as pet only with a limited registration. (No breeding rights)

Your puppy has been on a vaccination and de-worming schedule here and is up to date and these records will be provided to you. Please take these records to your veterinarian, as it is very important to continue with these vaccinations and wormings after you get your puppy home. Please do not forget the annual booster after that.

BUYER AGREEMENTS:

Buyer agrees to maintain the puppy/dog health with yearly vaccinations and care specified by their veterinarian. Should the puppy /dog become ill or unsound, any and all cost of treatment will be the responsibility of the buyer and not reimbursed by the seller.

To ensure the safety of the said puppy/dog it must be in a safe secure fenced in area while at home while outside or on a leash when outside of the premises. UNDER NO CIRCUMSTANCES is the said puppy/dog to be housed on a chain. Seller reserves the right to remove the said puppy/dog if at any time seller believes that the puppy/dog is in a unsafe or unfit environment.

Buyer agrees to provide proper socialization/exercise to the said puppy/dog. This breed requires a lot of attention. Crate training is acceptable but is not to be used as only source of containment. This breed needs time to run and play. NO JUMPING, EXCESSIVE EXERCISE, AND LIMITED USEOF STAIRS UNTIL PUPPY REACHES FULL GROWTH (18-24 months).

Buyer agrees to provide the breeder with a current photo every 12 months through the life of the said puppy/dog. This is to ensure that the puppy/dog is in good health and still resides in the buyers home. Buyer agrees that the said puppy/dog is to never be bred. If seller finds this activity has taken place there will be a penalty of $1,000 per litter sold, and seller has right to repossess the dog and any offspring produced.

Buyer agrees that the said puppy/dog will be fed quality LARGE BREED PUPPY/ADULT dog food until puppy reaches at least 18 MONTHS OF AGE. It is very important that puppy/dog is kept on food made for large breed dogs. Puppy/dog must maintain appropriate weight.

Buyer agrees that if at any time and for any reason he/she is unable to keep or properly care for the puppy, it must be returned to the breeder and no refund of any kind will be given. If puppy/dog is to be placed in new home it must be agreed upon by breeder.

Buyer agrees that dog registration must carry Donoma’s kennel name.

If for any reason we the breeder and the original buyer of this said puppy/dog should end up in a court of law, then the original buyer hereby agrees to bare any and all court costs and attorney fees for both the breeder and original buyer. Furthermore it is agreed that any court proceedings shall be held in the state of New York and in Broome county.

Both the buyer and seller have read the above contract and understand and agree to all the conditions stated herein. No amendments have been made to this contract. This contract is legal and binding.
